Terms of Service

1. Acceptance of terms

By accessing or using EateryHub ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all visitors, restaurant operators, team members, and guests who interact with the platform.

2. Description of service

EateryHub provides a cloud-based restaurant reservation management platform, including booking pages, form builders, guest management tools, and analytics. The Service is provided "as is" and we reserve the right to modify or discontinue features at any time with reasonable notice.

3. Account registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You must be at least 18 years old to create an account. One account per restaurant location is required unless you are on a multi-location plan.

4. Subscription plans and billing

EateryHub is billed annually in advance at the price shown at signup and in your Billing settings. All prices are in USD unless stated otherwise. We use Stripe for payment processing — by subscribing you agree to Stripe's terms of service.

You may cancel your subscription at any time from the Billing page. Cancellation takes effect at the end of the current billing period; no partial refunds are issued.

We reserve the right to change pricing with 30 days' notice to active subscribers.

5. Restaurant operator responsibilities

As a restaurant operator, you are responsible for:

  • Accurately representing your availability, hours, and policies to guests
  • Honouring reservations made through the platform
  • Obtaining any consent required to collect guest personal data under applicable law
  • Not using the platform for unlawful purposes or to send spam
  • Keeping your team members' access permissions up to date

6. Guest data

Guest reservation data (name, email, phone, special requests) is collected and stored on behalf of the restaurant operator. Operators are the data controllers for their guests' data. EateryHub acts as a data processor. See our Privacy Policy for details.

7. Acceptable use

You agree not to:

  • Attempt to reverse-engineer, decompile, or extract source code from the Service
  • Scrape, crawl, or systematically harvest data from the platform
  • Use the Service to send unsolicited communications to guests
  • Impersonate another restaurant or person
  • Upload malicious code or attempt to compromise platform security

8. Intellectual property

The EateryHub platform, including its design, code, and branding, is owned by EateryHub and protected by copyright. Your restaurant content (name, logo, menu, etc.) remains your property. By uploading content, you grant us a licence to display it on your booking page.

9. Limitation of liability

To the maximum extent permitted by law, EateryHub shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total liability to you for any claim arising from use of the Service shall not exceed the subscription fees paid by you in the 3 months preceding the claim.

10. Service availability

We aim for 99.9% uptime but do not guarantee uninterrupted availability. We are not liable for losses caused by downtime, data loss, or service interruptions.

11. Termination

We reserve the right to suspend or terminate accounts that violate these terms. Upon termination, your data will be retained for 30 days before deletion, giving you time to export it.

12. Governing law

These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles.

13. Changes to these terms

We may update these terms. We will notify you by email at least 14 days before material changes take effect. Continued use after that date constitutes acceptance.
